Affiliate Program Terms and Conditions

OVERVIEW

Welcome to the Vibing Beast Affiliate Program (“Program”). These Terms and Conditions (“Agreement”) govern your participation as an affiliate (“Affiliate,” “you,” “your”) of Vibing Beast (“we,” “us,” “our,” or “Company”).

By joining the Program, you agree to the terms outlined here. You should read them carefully before applying or promoting Vibing Beast products.

SECTION 1 - ELIGIBILITY & ENROLLMENT

To participate in the Vibing Beast Affiliate Program, you must be at least 18 years old and operate an active, publicly accessible social media account, blog, website, or online channel that aligns with Vibing Beast’s brand values. Participation in the Program is subject to approval, and Vibing Beast reserves the right to approve or reject any application at its sole discretion. Approval may be revoked at any time if an affiliate’s conduct, content, or engagement is deemed inconsistent with our brand image or in violation of this Agreement.

SECTION 2 - COMMISSION RATE & PAYMENT TERM

Affiliates earn commissions based on verified sales generated through their assigned discount codes. The table below outlines the current commission structure, including the applicable discount for followers and performance-based tiers available under the Vibing Beast Affiliate Program.

Commissions are calculated on the discounted subtotal before taxes and shipping, based solely on verified sales tracked through UpPromote and Shopify order data. Each affiliate has access to a personal UpPromote dashboard, where they can view real-time reports of verified sales, commissions earned, and tier status. This dashboard serves as the official record for commission calculations. Vibing Beast is not responsible for discrepancies or data mismatches arising from third-party tracking systems or external analytics tools.

Each affiliate’s unique discount code tracks orders in UpPromote and determines tier eligibility.
Tier progress resets on the first day of each month, ensuring every affiliate’s performance is measured fairly. Orders that are canceled or disputed within 7 days of purchase are ineligible for commission.

Commissions are paid monthly via PayPal on the first Friday of the following month, with a minimum payout threshold of $50 USD (balances below this amount roll over to the next month). Affiliates are solely responsible for reporting and paying all applicable taxes on their earnings. Vibing Beast reserves the right to modify commission rates, payout schedules, or program rules with seven days’ written notice. Continued participation in the Program constitutes acceptance of any updates.

SECTION 3 - BRAND USE GUIDELINES

Affiliates may use official Vibing Beast product photos, descriptions, and marketing materials provided by the Company solely for the purpose of promoting our products. Affiliates may not run paid ads or sponsored content that bid on or use the term “Vibing Beast” or any close variation without written approval.

Affiliates must represent our brand in a responsible and ethical manner. The following activities are strictly prohibited: spamming links or unsolicited messages, making false, exaggerated, or misleading claims about products, promoting illegal or offensive content, using our name or images misleadingly, listing codes on coupon websites, or using bots and fake followers. Vibing Beast reserves the right to request details on affiliate promotions, review posts, and require removal of misleading content. Non-compliance may result in suspension or termination.

Affiliates agree not to make defamatory or negative statements about Vibing Beast or its products. Constructive feedback must be sent privately to support@vibingbeasts.com. Violation of these rules may result in immediate removal and forfeiture of unpaid commissions.

SECTION 4 - COPYRIGHT & OWNERSHIP OF CONTENT

All brand assets, product images, and marketing materials remain the property of Vibing Beast. Any promotional content you create that includes our products, trademarks, or materials will be considered joint marketing content, and Vibing Beast retains the right to reuse or repost it on our platforms. Affiliates may not claim exclusive ownership over any content created using our brand assets. 

Affiliates grant Vibing Beast a perpetual, worldwide, royalty-free license to reuse, repost, modify, or adapt any promotional content featuring our products for marketing purposes across all media formats.

SECTION 5 - COMPLIANCE WITH MARKETING & ADVERTISING LAW

Affiliates must comply with FTC endorsement rules, clearly disclose their affiliate relationship, and follow platform-specific ad policies. Affiliates are solely responsible for compliance and agree to indemnify Vibing Beast for penalties or claims from non-compliance. Affiliates are also responsible for following all applicable platform-specific rules, advertising standards, and privacy laws relevant to their audience or region.

SECTION 6 - TERMINATION & MISCONDUCT

Vibing Beast reserves the right to suspend or terminate an affiliate’s participation in the Program if there is evidence of misconduct, misrepresentation, or any activity that violates these Terms and Conditions. Termination decisions are made at Vibing Beast’s discretion and are intended to protect the integrity and reputation of the brand.

Upon termination, affiliates must immediately discontinue the use of Vibing Beast’s name, trademarks, logos, and marketing materials. Pending commissions for verified sales will be paid according to the normal payout schedule, unless forfeited due to fraudulent behavior, prohibited conduct, or misuse of discount codes.

Affiliates who attempt to manipulate tracking systems, promote misleading or false content, or engage in actions that harm Vibing Beast’s reputation will forfeit all unpaid commissions and may be required to return previously paid commissions if misconduct is confirmed. Once an affiliate is removed from the Program, reapplication or continued participation will require prior written approval from Vibing Beast.

SECTION 7 - LEGAL, LIABILITY & CONFIDENTIALITY

Affiliates agree to indemnify and hold Vibing Beast harmless from any claims, damages, or costs resulting from their promotional activities, statements, or legal violations. 

All non-public or proprietary business information shared by Vibing Beast, including program data and customer details, must remain confidential. Vibing Beast’s total liability under this Agreement shall not exceed commissions paid to the affiliate during the preceding three months. All confidential business, sales, and program data provided by Vibing Beast must be treated as strictly confidential and may not be disclosed to third parties without prior written consent.

SECTION 8 - GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Ohio, USA, without regard to conflict of law principles. Any disputes, claims, or controversies arising out of or relating to this Agreement shall be resolved in a competent court located in Franklin County, Ohio, or through mutually agreed remote arbitration, in order to reasonably accommodate affiliates located outside Ohio.

Both parties agree to act in good faith to resolve any dispute amicably before pursuing formal legal or arbitration proceedings.

SECTION 9- AGREEMENT & ACKNOWLEDGMENT

This Agreement represents the full understanding between you and Vibing Beast. By participating, you agree to comply with all terms and applicable laws. Continued participation signifies acceptance of future updates. By submitting your affiliate application or using your affiliate code, you electronically accept and agree to these Terms and Conditions.
